breakoutstructure.com is responsible for the personal data described in this policy. For any privacy or data protection matter, including a request to exercise your rights, contact support@breakoutstructure.com. We aim to acknowledge messages within 4 hours.

We have not appointed a Data Protection Officer, and we are not required to. Data protection enquiries are handled directly at the address above.

Data you provide

• Account data: name, email address and password credentials.
• Subscription data: your plan and its status. Payments are made through the Apple App Store or Google Play — we do not receive or store your card, bank or payment details at any point.
• Configuration data: the instruments, markets, timeframes, alert preferences and risk value you set within the product.
• Support data: the contents of messages you send us.

Data collected automatically

• Usage data: features used and actions taken within the app.
• Device and technical data: IP address, device type, operating system and app version.

This website collects nothing

The breakoutstructure.com website sets no cookies, runs no analytics or tracking scripts, and stores nothing in your browser. Visiting it does not create a record associated with you. See our Cookie Policy.

We do not collect broker or exchange credentials, and the Service has no execution capability that would require them.

• To provide the Service and your account — necessary for performance of our agreement with you.
• To verify your subscription status with the app store — performance of our agreement with you.
• To operate, secure, debug and improve the product — our legitimate interest in running a reliable service.
• To send service and security messages — performance of our agreement with you.
• To respond to your support requests — performance of our agreement with you.
• To meet legal and tax obligations — compliance with a legal obligation.

We do not send marketing email, and we do not build advertising or behavioural profiles. Where we rely on legitimate interests, we have considered whether those interests are overridden by your rights.

The Service analyses market data, not your personal data, to produce its output. We do not carry out automated decision-making that produces legal or similarly significant effects concerning you.

We do not sell your personal data, and we do not share it for advertising. We share it only with:

• Apple and Google, which process subscription purchases and provide the app distribution platforms.
• Service providers who process data on our behalf to run the product — hosting and infrastructure, message delivery and customer support. They act on our instructions and may not use your data for their own purposes.
• Authorities, where required by law or to establish, exercise or defend legal claims.

The infrastructure we use may process data in countries other than your own. Where data is transferred out of a jurisdiction that restricts such transfers, we rely on an appropriate safeguard recognised under that jurisdiction's law, such as standard contractual clauses or an adequacy decision.

We keep personal data only as long as necessary for the purposes described above. Account and configuration data is retained while your account is active. When you close your account we delete or anonymise your data, except where we are required to retain records to meet a legal or tax obligation, or where we need to keep limited records to establish, exercise or defend a legal claim.

All traffic to the website and the Service is encrypted in transit using TLS. Access to systems holding personal data is restricted to those who need it to operate the Service.

No system is perfectly secure and we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at support@breakoutstructure.com.

Depending on where you live, you may have the right to:

• Access the personal data we hold about you.
• Correct inaccurate or incomplete data.
• Delete your data, in certain circumstances.
• Receive your data in a portable, machine-readable format.
• Object to, or request restriction of, certain processing.
• Withdraw consent at any time, where processing is based on consent.
• Complain to your local data protection supervisory authority.

To exercise any of these rights, contact support@breakoutstructure.com. We respond within the period required by the law that applies to you, and will tell you if we need longer for a complex request.

The Service is not directed at children and we do not knowingly collect data from anyone under 18. If you believe a child has provided us data, contact support@breakoutstructure.com and we will delete it.

We will post any changes on this page and update the effective date. Material changes will be notified in the app.
